Terms and Conditions

Welcome to CVSmart, an online recruitment and career development platform owned and operated by MindMatch Consulting (Pty) Ltd (“MindMatch”, “we”, “our” or “us”).

By creating an account, uploading your CV, applying for jobs, purchasing premium services, or otherwise using the CVSmart platform (“Platform”), you agree to comply with and be bound by these Terms and Conditions.

If you do not agree to these Terms, please do not use the Platform.

1. Acceptance of these Terms

These Terms govern your use of the CVSmart Platform and any related services offered by MindMatch Consulting.

By using the Platform, you acknowledge that you have read, understood and accepted these Terms and Conditions, together with our Privacy Policy.

2. Eligibility

To use the Platform, you confirm that:

• You are at least 16 years of age, or the minimum legal age required in your country to use online recruitment services without parental consent.
• All information you provide is true, complete and accurate.
• You will register only one account in your own name.
• You will not impersonate another individual or create an account on behalf of another person without their authority.
• You will keep your account information current and accurate.

MindMatch reserves the right to suspend or terminate accounts containing false, misleading or fraudulent information.

3. Free Recruitment Services

CVSmart is committed to making job searching accessible to all candidates.

The following services are provided free of charge:

• Creating a CVSmart account
• Uploading your CV
• Creating and maintaining your candidate profile
• Applying for vacancies advertised on the Platform
• Being considered for employment opportunities
• Receiving job alerts and vacancy notifications (where applicable)

CVSmart does not charge candidates any recruitment, application or placement fees.

Employers who recruit through the Platform may pay recruitment fees to MindMatch Consulting. These fees are never payable by candidates.

Job Alerts

CVSmart may notify you of vacancies that match your profile or preferences.

Receiving a job alert or vacancy notification does not mean that you have been shortlisted, interviewed or selected for a position.

4. Premium Career Services

CVSmart offers optional premium career development services designed to help candidates improve their employability.

These services may include, but are not limited to:

• Professional CV enhancement
• CV writing services
• AI-assisted CV optimisation
• Interview preparation
• Career coaching
• Salary benchmarking and market insights
• Skills assessments
• Career resources and learning materials
• Other premium career tools introduced from time to time

These services are entirely optional.

Purchasing premium services is not required to apply for jobs or to be considered for employment opportunities through CVSmart.

Premium services may be purchased:

• individually on a pay-per-use basis; or
• through a monthly subscription.

Applicable pricing will always be displayed before purchase.

5. Subscription Services

Where you subscribe to a recurring premium plan:

• your nominated payment method will automatically be charged at the beginning of each subscription period;
• subscriptions automatically renew unless cancelled before the next billing date;
• you may cancel your subscription at any time through your account or by contacting us;
• cancellation prevents future billing but does not automatically entitle you to a refund for the current subscription period.

MindMatch reserves the right to modify subscription fees or introduce new subscription options. Any pricing changes will be communicated before taking effect.

6. Payments and Refunds

Payments for premium services are processed through secure third-party payment providers.

Unless otherwise required by law:

• completed services are non-refundable;
• digital products already delivered are non-refundable;
• subscriptions remain active until cancelled by the user.

Refund requests for services not yet delivered may be considered at MindMatch’s sole discretion.

7. No Guarantee of Employment

CVSmart is a recruitment and career support platform that connects employers and job seekers.

While we endeavour to match suitable candidates with employment opportunities, we cannot and do not guarantee:

• employment;
• interviews;
• job offers;
• placement with any employer;
• a particular salary;
• career advancement; or
• any specific recruitment outcome.

Employers retain sole responsibility for their recruitment decisions.

8. Candidate Responsibilities

You agree that:

• all information submitted is truthful and accurate;
• your CV accurately reflects your qualifications and experience;
• you will not submit false, misleading or fraudulent information;
• you own or have permission to upload all documents submitted;
• you will maintain the confidentiality of your account credentials;
• you will promptly update your profile if your details change.

You remain solely responsible for the content you upload to the Platform.

9. Your CV and Personal Information

By uploading your CV and creating a profile, you authorise MindMatch Consulting to:

• securely store your information;
• process your personal information for recruitment and career development purposes;
• match your profile with relevant employment opportunities;
• share your CV with prospective employers where appropriate;
• contact you regarding vacancies, applications and recruitment opportunities;
• provide personalised career insights and recommendations.

Your information will be processed in accordance with the Protection of Personal Information Act (POPIA) and our Privacy Policy.

You may request that your profile be updated or deleted, subject to any legal or regulatory obligations requiring us to retain certain records.

10. Intellectual Property

All Platform content, including but not limited to:

• software;
• branding;
• logos;
• graphics;
• templates;
• AI tools;
• career resources;
• written material;
• assessments; and
• proprietary methodologies,

remain the intellectual property of MindMatch Consulting or its licensors.

You may not copy, reproduce, distribute, modify or commercially exploit any content without our prior written permission.

11. Acceptable Use

You agree not to:

• upload false or misleading information;
• upload malicious software or harmful content;
• attempt to gain unauthorised access to the Platform;
• interfere with Platform security or functionality;
• misuse the Platform for unlawful purposes;
• attempt to copy or reverse engineer any part of the Platform.

MindMatch reserves the right to suspend or terminate accounts that breach these Terms.

12. Limitation of Liability

While we endeavour to provide a reliable Platform, MindMatch does not warrant that:

• the Platform will always be available;
• vacancies will remain open;
• employers will respond to applications;
• recruitment outcomes will meet user expectations;
• salary estimates will always be accurate;
• AI-generated recommendations will always be correct or complete.

To the fullest extent permitted by law, MindMatch Consulting shall not be liable for any direct, indirect, incidental, consequential or special damages arising from the use of the Platform or any services offered through it.

13. AI-Powered Features

Certain CVSmart services use artificial intelligence to generate:

• CV recommendations;
• interview guidance;
• career suggestions;
• skills recommendations;
• salary insights; and
• other personalised content.

These outputs are intended for informational purposes only.

Although we continually improve our AI systems, they may occasionally generate inaccurate, incomplete or outdated information.

Users remain responsible for reviewing and verifying all AI-generated content before relying on or submitting it to employers.

AI-generated content should not be regarded as legal, financial or professional advice.

14. Salary Information and Market Insights

Salary benchmarking and remuneration information available through CVSmart is based on market data and analytical models.

These figures are intended as general guidance only and should not be interpreted as guaranteed salary offers.

Actual remuneration may vary depending on factors including:

• employer budgets;
• geographic location;
• industry;
• qualifications;
• experience;
• skills;
• market demand; and
• internal remuneration policies.

15. Employer Listings and Vacancy Information

CVSmart acts as a platform connecting employers and job seekers.

MindMatch makes reasonable efforts to work with reputable employers but does not warrant:

• the accuracy of vacancy information;
• that vacancies remain available;
• that employers will respond to applications; or
• that employers will complete their recruitment processes.

Employers are solely responsible for:

• job advertisements;
• recruitment processes;
• interview decisions;
• offers of employment; and
• employment contracts.

16. Changes to the Platform

MindMatch may:

• introduce new services;
• discontinue existing services;
• modify Platform functionality;
• update pricing;
• amend these Terms and Conditions.

Where material changes are made, reasonable notice will be provided where required by law.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

17. Privacy and Communications

MindMatch is committed to protecting your personal information.

Your personal information is collected, stored and processed in accordance with applicable data protection legislation, including POPIA.

By creating an account, you consent to receiving communications relating to:

• job opportunities;
• application updates;
• interview notifications;
• account administration;
• security notifications;
• Platform updates; and
• other recruitment-related communications.

From time to time, we may also send information regarding:

• new Platform features;
• premium services;
• career resources;
• webinars;
• promotions; and
• newsletters.

You may opt out of marketing communications at any time, although you will continue to receive essential service-related communications.

18. Suspension or Termination

MindMatch reserves the right to suspend or terminate your account where:

• these Terms have been breached;
• fraudulent activity is suspected;
• false information has been provided;
• your use of the Platform presents a security risk;
• required by law; or
• necessary to protect other users or the integrity of the Platform.

19. Account Inactivity

To maintain an accurate candidate database, MindMatch may archive or deactivate accounts that have remained inactive for 24 consecutive months.

Where reasonably practicable, users will be notified before an account is archived or removed.

Archived users may reactivate their accounts by contacting MindMatch or creating a new account, subject to the Terms applicable at that time.

20. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the South African courts.
